Delivery:

The Delivery of products is done through specialized signature vans in customized bags to maintain privacy of the order. Delivery charges for any order of less than Rs. 200 will be Rs. 20/order/delivery for fruits and vegetable vendor and Rs 20 for each if there are two vendors.

Out of Stock situations:

Our endeavor is to ensure that all products listed on the app are available in stock for dispatch to the buyer. However in case this in not available for any reason, we will contact you on delivery day and give you the option to exchange, delay or cancel the order based on your convenience.\n

Notwithstanding other legal remedies that may be available to Fruitfal Technologies India Pvt Ltd. , the Company may in its sole discretion limit User activity by immediately removing User listing either temporarily or indefinitely or suspend or terminate User membership, and/or refuse to provide User with access to the Site. If the User is in breach any of the terms and conditions of this Agreement. If the User has provided wrong, inaccurate, incomplete or incorrect initiation. If your actions may cause any harm, damage or loss to the other Users or Fruitfal Technologies India Pvt Ltd.

Indemnity

User agrees to defend, indemnify and hold harmless Fruitfal Technologies India Pvt Ltd. , its employees, directors, officers, agents and their successors and assigns and against any and all claims, liabilities, damages, losses, costs and expenses, including attorneys fees, caused by or arising out of claims based upon the use of Users actions or inactions, including but not limited to any warranties, representations or undertakings or in relation to the non-fulfilment of any of its obligations under this Agreement or arising out of the Users infringement of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this Agreement.

Governing Law and Jurisdiction:

This website is created and controlled by Fruitfal Technologies India Pvt Ltd. in Faridabad, Haryana, India and the laws of India shall apply. This agreement is governed and construed in accordance with the Laws of India. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Faridabad, Haryana, India, in all disputes arising out of or relating to the use of site FRUITFAL.COM. Shipment of Products:

Purchases are shipped from our own or third party warehouses/ stores or offices from various points in India. Our endeavor is to make the products reach you within 12 hours from receipt of order and payment. Order deliveries will be made usually between 7:00 AM - 10:00 PM, Monday to Sunday except under unavoidable situations. Goods will need to be signed for upon delivery. We take no responsibility for goods signed by an alternative person other than the person ordering the product at the address indicated at the time of the order. Since the transactions are authorised by the card holder, we do not take responsibility for incorrect addresses provided at the time of placing the order. The delivery will NOT be redirected / redelivered to any other address in any circumstance. The selected product will be delivered only in the city it is mentioned as available on this Site. Fruitfal Technologies India Pvt Ltd. shall not be held responsible for damage of products after delivery. Fruitfal Technologies India Pvt Ltd. will contact the customer on the first time confirm the date, time address of delivery. If the delivery fails due to following reasons, Fruitfal Technologies India Pvt Ltd. will contact the customer 2nd time to deliver goods levy delivery charges for the second attempt. In case the customer refuses to pay the second time delivery charges, Fruitfal Technologies India Pvt Ltd. will refund the entire order money to the

Customer.

Fruitfal Technologies India Pvt Ltd. will consider the order delivery failed in the following cases: Delivery not done due to wrong address. Recipient not available.

Premises locked.

In case of floods/ Heavy Rains/ National Bandh we reserve the right to reschedule the delivery for another date. In case the product is not delivered due to any of the above reasons, we will inform you about the same. All claims for shortages or damages must be reported at the time of delivery. Once you accept the products/order, afterwards no claim will be entertained by the company. Also the said shortage of goods needs be highlighted and signed on the delivery challan copy in the app and returned to the delivery person.

Delivery Charges:

Shipping and handling rates may vary based on product, packaging, size, volume, type and other considerations. The shipping and handling charges are given at the time of check out and consumers will know about this before making payments.

Product returns:

Once products are delivered to you and accepted as accurate and as per the original order, there is no refund or exchange possible. To return any items that are damaged or expired or not as per your original order, kindly return these products to the delivery person along with a remark on the delivery receipt. Please contact customer service by email/Phone through the contact us link on the website (https://fruitfal.com/contact) and the app mention the return of products along with the order number , and the date of delivery in the app itself. All returned items must be accompanied by the original receipt, a return / exchange authorization number and in unopened, saleable condition at the time of delivery. Postage and charges for return of these will not be refunded. Please note that in any case we cannot offer exchanges or refunds on any sale, opened or used products. Perishable will not be refunded or exchanged. Perishable items need to be checked during delivery and if accepted will not be refunded or exchanged.

Disclaimer:

We as a Retailer shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
